The petition filed towards the delay within the mayor’s election sought to convene the assembly of the Municipal Company Home inside every week, to not adjourn the proceedings of the Home till the election of the mayor is accomplished, and to declare that the nominated councilors (members) of the company Don’t have the fitting to vote within the mayoral elections, and many others. have been pleaded.

Senior advocate AM Singhvi appeared for the petitioner earlier than a three-judge bench headed by Justice Chandrachud. He mentioned that although the elections have been to be held in December, 2022, the current scenario is that the elections for the Mayor, Deputy Mayor and members of the Standing Committee haven’t been held.

He cited Article 243-R of the Structure to say that nominated members of the Municipal Company of Delhi Home can’t be allowed to vote. It’s unconstitutional to permit these members to vote within the election of mayor and different posts.

The assembly of the Municipal Company of Delhi Home was adjourned for the third time on February 6. The mayoral election was postponed following a scuffle between a number of councilors of the Bharatiya Janata Party (BJP) and AAP amid big uproar.

The MCD elections have been held in December final 12 months, during which AAP had gained 134 out of 250 wards. BJP had gained in 104 wards.
