The Supreme Court has reminded that the Central Government has the power to control the price of Kovid vaccine. “Different companies set different prices for the vaccine. The government has the power to intervene under the Drugs Control Act and the Patent Act. What did the government do? Ahead is the national crisis created by the epidemic. If the power has not been exercised now, when will it be used again? ‘
The apex court’s question is whether it is considering a case taken voluntarily in the Kovid circumstances. The court also directed to explain how many vaccines are required to be given to those above 18 years of age and what steps have been taken to address the vaccine shortage.
‘Can’t be a dumb witness’
Justice DY Chandrachud said the Supreme Court could not be a silent witness in the national crisis caused by Kovid. Various High Courts are considering cases related to Kovid. It does not intend to bar the High Courts from it. The High Courts have some limitations to deal with. Necessary interventions will be made in it. It is in this context that the Supreme Court voluntarily took up the case, the judges explained. The Center has also been directed to submit a report on the supply of oxygen and medicines and price control of vaccines. The Supreme Court will reconsider the case on Friday. Currently, 11 high court cases are pending.
Appointed amicus curiae
Senior advocates Jaideep Gupta and Meenakshi Arora have been appointed as amicus curiae to assist the Supreme Court in the case. Earlier appointed amicus curiae Harish Salve had withdrawn.
Center says there is no politics in oxygen
The Solicitor General told the court on behalf of the Central Government that there was no politics involved in the supply of oxygen. The Solicitor General said that he did not hesitate to commend Kerala and Tamil Nadu for handling the oxygen issue well.
