Supreme Court holds that membership of a proscribed organization is an offense under UAPA; The earlier order is cancelled

NEW DELHI: The Supreme Court docket held that membership of a banned group is a rechargeable offense below the UAPA Act. A bench comprising Justices MR Shah, CT Ravikumar and Sanjay Carroll dominated that the case may be filed for membership of a banned group below Section 10(a) (i) of the UAPA Act.

The Supreme Court docket overturned a 2011 ruling that UAPA couldn’t be imposed on the only floor of membership of a banned organisation.
