Threat on Mukhtar Ansari’s legislature? Know the reason and rules behind it

Bahubali is not taking the name of Mukhtar Ansari’s woes. Mukhtar is a BSP MLA from the Legislative Assembly. There is a danger of losing his membership due to non-inclusion of 60 consecutive days in the assembly session proceedings. A petition regarding this is also under consideration with the Speaker of the Assembly, Haynarayan Dixit.

The Speaker said that Article 192 of the Constitution provides that if a member remains absent for 60 consecutive days in the House, then the House can cancel its membership. He said that on November 4, 2020, Sudhir Singh, who ran an anti-mafia forum in Varanasi, had petitioned the Speaker to cancel the membership of MLA Mukhtar Ansari. He has said in his petition that he is not attending any session of the assembly or constitutional discussion. Whereas according to the Constitution of India, the provision to cancel the membership of the MLA who has been absent in the session for 60 consecutive days and hence he calls for the cancellation of Ansari’s membership. Sudhir Singh, the chairman of the petitioner anti-mafia forum, has met Assembly Speaker Haynarayan Dixit and Parliamentary Affairs Minister Suresh Khanna regarding this.

Now, after studying that petition, it has been sent to the legal opinion. If a petition comes from the BJP, it can be disposed of whenever the House convenes by conducting a test. Dixit told that it has been more than 60 days for Mukhtar Ansari. These days are counted only when the House moves.

Significantly, the mafia MLA Mukhtar Ansari has been kept in the Philahal 16 number Mulahija Barrack in Banda Mandal Prison. On the instructions of the jail headquarters, the mafia will remain in it for six days. This barrack can become its permanent destination. Police team has filed for mafia from jail in Rupnagar in Punjab at 4:30 am on Wednesday in Banda jail premises. On the other hand, the security system in the jail has been kept very tight. CCTVs have been installed at the jail gate. They have been put in the number of 50.
