The Supreme Court held that a wife cannot be compelled to live with her husband and that the wife is not the property or slave of the husband. The petition of the UP native to direct his wife to live with him was considered. ‘What do you think? The wife is not the property or slave of the husband. They cannot be ordered to stay with you ‘- the bench comprising Justices Sanjay Kishan Kaul and Hemant Gupta observed.
In 2013, the wife filed for divorce, alleging abuse of her husband. In 2015, a family court in Gorakhpur ordered him to pay Rs 20,000 as alimony to his wife. However, the husband approached the Allahabad High Court arguing that he was willing to stay with his wife and was not liable to pay alimony under the Hindu Marriage Act. The petition was rejected and the Supreme Court was approached.
